Terms of Service

Welcome to Catchy Cards. These Terms of Service ("Terms") govern your access to and use of the Catchy Cards mobile application and website (the "Service"), provided by Design 86 LLC ("we", "us", or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years of age to use Catchy Cards. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. User Accounts

To use certain features, such as syncing cards via Firebase, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to disable any account at our discretion.

3. User-Generated Content

Catchy Cards allows you to draw, sketch, and write text ("Content"). You retain all ownership rights to the drawings and text you create.

Content Restrictions (The "No NSFW" Rule)

You agree not to create, upload, or share any Content that:

• Is sexually explicit or contains "Not Safe For Work" (NSFW) imagery.
• Is hateful, defamatory, or discriminatory.
• Infringes on the intellectual property of others (e.g., drawing copyrighted characters like Mickey Mouse for public distribution).
• Contains personal private information of others.

Immediate Ban: We reserve the right, at our sole discretion, to remove any Content and/or permanently ban users immediately and without warning who violate these restrictions.

Public Sharing License

When you mark a card set as "Public" or "Visible," you grant Catchy Cards a limited, worldwide, non-exclusive, royalty-free license to host, display, and distribute that Content to other users within the app. You may revoke this license at any time by deleting the Content or marking it as "Private."

4. AI-Powered Features (OpenAI)

Catchy Cards utilizes OpenAI’s GPT-4o technology to process image recognition and translations.

• Accuracy Disclaimer (Hallucinations): AI technology can make mistakes. We do not guarantee the accuracy, completeness, or usefulness of any translation provided by the Service.
• User Risk: You use AI-generated translations at your own risk. We are not liable for any damages, academic failures, or misunderstandings resulting from incorrect translations.

5. Service Availability & Third Parties

The Service relies on third-party providers, including Google Firebase (for storage) and OpenAI (for processing).

• Service Interruptions: We are not liable for any service interruptions, downtime, or data loss caused by these third parties or by general internet connectivity issues.
• Modifications: We reserve the right to modify or discontinue any part of the Service at any time without notice.

6. Limitation of Liability

To the maximum extent permitted by law, Design 86 LLC shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service, including but not limited to loss of data, loss of profits, or translation errors.

7. Fees

The Service is currently provided free of charge. We reserve the right to introduce subscriptions or "Pro" features in the future, which will be governed by additional terms and Apple's In-App Purchase policies.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the app after changes are posted constitutes your acceptance of the new Terms.
